1. Acceptance of these terms
These Terms of Service (the “Terms”) govern your use of the website at tools.subcubic.com and the free tools we provide there (the “Service”). The Service is operated by Subcubic LLC, a New York limited liability company (“Subcubic”, “we”, “us”, “our”).
By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
tools.subcubic.com is a collection of free, self-serve calculators and graders intended for use by small and mid-sized business owners and operators. Each tool accepts inputs you provide, computes a result, and gives you the option to receive a written report by email.
The Service is provided free of charge. We may add, modify, or retire individual tools at any time without notice.
3. Estimates only — not financial advice
The numbers our tools compute are estimates based solely on the inputs you provide. They are intended for directional guidance and education, not as financial, legal, accounting, or professional advice.
You should not make business or financial decisions based only on the output of one of our tools. We make no representation that the estimates will reflect actual results in your business. Always consult qualified professionals for advice specific to your situation.
4. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by law, Subcubic disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability.
We do not warrant that the Service will be error-free, secure, or free from interruption, or that any defects will be corrected.
5. Limitation of liability
To the maximum extent permitted by law, Subcubic and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.
Because the Service is provided free of charge, our total cumulative liability to you for any claim arising out of or relating to the Service is limited to one hundred US dollars ($100).
6. Acceptable use
You agree not to:
- Use the Service in a way that violates any applicable law or regulation
- Submit information that you know to be false or another person's personal information without authorization
- Probe, scan, scrape, reverse-engineer, or attempt to bypass security or rate limits on the Service
- Use automated systems (bots, scripts, scrapers) to access the Service in a way that places an unreasonable load on our infrastructure
- Use the Service to send spam, distribute malware, or engage in any abusive, harassing, or unlawful activity
We reserve the right to suspend or block any user who, in our sole judgment, violates this section.
7. Intellectual property
Subcubic owns all rights, title, and interest in and to the Service, including the tools themselves, the underlying code, the methodologies, the visual design, and the brand. You receive no license to any of those except the limited right to use the tools as intended.
You retain ownership of the data you submit. By submitting data to a tool you grant Subcubic a non-exclusive, worldwide, royalty-free license to process that data for the purposes described in our Privacy Policy.
8. Email communications
When you submit your email address to receive a report, you consent to receive that report and follow-up emails from us about Subcubic services that may be relevant to the result you saw. You can opt out of follow-up emails at any time by replying to any of our emails or by emailing hello@subcubic.com.
tools.subcubic.com does not collect phone numbers or send SMS.
9. Changes to the Service and these Terms
We may modify, suspend, or discontinue any part of the Service at any time, including individual tools, without notice or liability.
We may also update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Your continued use of the Service after a change constitutes acceptance of the updated Terms.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
Sections that by their nature should survive termination (including limitations of liability, intellectual property, and governing law) will survive.
11. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will first be addressed by good-faith negotiation, then by mediation, and finally, if necessary, by binding arbitration in New York, consistent with the dispute-resolution process described in the main Subcubic terms of service.
